Key Laws and Protections
1. Supremacy Clause (Article VI, U.S. Constitution)
The Constitution is the supreme law of the land. No state law can override or substitute itself for constitutional protections.
2. Fifth Amendment – Grand Jury Indictment
“No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury.”
Some states allow charges by “information” instead of grand jury indictment. While state procedures vary, bypassing this safeguard can raise serious constitutional questions.
3. Fourth Amendment – Warrant Requirement
Protects against unreasonable arrests or searches. Arrests without warrants are generally unlawful except in limited, recognized circumstances.
4. Federal Statutes on Deprivation of Rights
18 U.S.C. § 241 – Conspiracy Against Rights: two or more people conspiring to deprive constitutional rights.
18 U.S.C. § 242 – Deprivation of Rights Under Color of Law: officials who intentionally violate constitutional rights.
